These Terms and Conditions ("Terms") govern your access to and use of https://retro-putt.com/ (the "Website") and your visit to and use of the Retro Putt Indoor Mini Golf facility operated by RETRO PUTT AT THE COVE, LLC ("Retro Putt," "we," "us," or "our") in Green Cove Springs, Florida (the "Facility," and together with the Website, the "Services"). By using the Website, making a purchase or booking, or entering the Facility, you agree to these Terms. If you do not agree, please do not use the Services.
1. Description of Services
Retro Putt operates an indoor mini golf entertainment venue in Green Cove Springs, Florida, offering two 18-hole indoor mini golf courses, memberships, parties and group events, food and beverage offerings, merchandise, and related guest services as available from time to time.
2. Eligibility; Minors
The Services are open to guests of all ages, subject to facility rules and applicable law. A participating minor must have the required waiver completed by the minor's natural guardian as applicable. Retro Putt may require proof of identity or age and may require appropriate adult supervision.
3. Liability Waiver Required
Before participating in mini golf or another activity requiring a waiver, each participating adult, or the natural guardian of a participating minor as applicable, must complete the required Retro Putt liability waiver. The waiver contains assumption-of-risk, release, and other terms and is incorporated into these Terms by reference. Retro Putt may refuse participation where a required waiver has not been completed.
4. Assumption of Risk
Mini golf and other recreational activities at the Facility carry inherent risks, including slips, falls, collisions, and injury. By participating, you acknowledge and voluntarily assume applicable risks to the fullest extent permitted by Florida law, subject to the specific terms of the signed liability waiver.
5. Facility Rules of Conduct
While at the Facility, all guests agree to:
Follow posted rules and reasonable instructions from Retro Putt staff;
Use equipment, clubs, courses, attractions, furnishings, and other property only as intended;
Supervise minors in their party as appropriate;
Refrain from unsafe, abusive, threatening, disorderly, or disruptive conduct; and
Refrain from bringing prohibited items, outside alcohol, or weapons onto the premises, except as expressly permitted by Retro Putt or applicable law.
Retro Putt may refuse service, end participation, or remove a guest from the Facility when reasonably necessary to enforce these rules or protect safety, subject to applicable law and any controlling transaction-specific terms.
6. Admission, Pricing, and Payment
Current pricing, hours, accepted payment methods, and offerings are posted at the Facility and/or on the Website. Retro Putt is a cashless venue and accepts approved card and contactless payment methods. Prices, hours, policies, and offerings may change from time to time.
7. Reservations, Parties, and Group Events
Parties, group events, private events, and other organized bookings may be subject to separate pricing, deposits, capacity limits, cancellation terms, facility rules, and written agreements disclosed during booking. Where separate booking terms apply, those terms control for the applicable event.
8. Cancellations, Refunds, Transfers, and Rescheduling
Admission, membership, party, group, event, and merchandise purchases may be subject to separate cancellation, refund, transfer, or rescheduling terms disclosed at the time of purchase or booking. Unless otherwise stated in writing, refunds are not guaranteed. Where a separate booking agreement, invoice, purchase policy, or membership agreement applies, that policy controls for the applicable transaction.
9. Photography and Video
Photography and video recording may occur during normal business operations, special events, and promotional activities. Guests may appear incidentally or in the background of such content. Separate consent may be required before intentionally featuring an identifiable guest as the primary subject of certain advertising or promotional content, particularly when a minor is involved.
10. SMS and Text Messaging
If you opt in, Retro Putt may send recurring marketing or non-marketing text messages depending on the specific consent you provide. Message frequency may vary. Message and data rates may apply. You may opt out at any time by replying STOP. After you send STOP, we may send a confirmation message that you have been unsubscribed. Reply HELP for assistance or contact Retro Putt at (904) 664-8772. Wireless carriers are not liable for delayed or undelivered messages. Consent to receive marketing text messages is not a condition of purchasing goods or services. 11. Website Use and Intellectual Property
Website content, including text, graphics, logos, images, and the Retro Putt name and marks, is owned by or licensed to RETRO PUTT AT THE COVE, LLC and is protected by applicable intellectual-property laws. You may use the Website for personal, non-commercial purposes. You may not copy, reproduce, distribute, modify, or create derivative works from Website content without prior written permission, except as permitted by law.
12. Prohibited Conduct on the Website
When using the Website, you agree not to use it for an unlawful purpose; attempt unauthorized access to the Website or related systems; introduce malicious or harmful code; interfere with operation or security; or scrape, harvest, or collect information about others without authorization.
13. Lost and Found; Personal Property
Retro Putt is not responsible for lost, stolen, or damaged personal property brought onto the premises, except to the extent responsibility cannot be excluded under applicable law. Found items may be held for a reasonable period consistent with our practices before being donated, discarded, or otherwise handled as permitted by law.
14. Limitation of Liability
To the fullest extent permitted by Florida law and subject to the signed liability waiver, RETRO PUTT AT THE COVE, LLC and its owners, officers, employees, and agents will not be liable for indirect, incidental, special, exemplary, or consequential damages arising from or related to use of the Services. Nothing in these Terms limits liability that cannot lawfully be limited.
15. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws principles.
16. Indemnification
You agree to indemnify and hold harmless RETRO PUTT AT THE COVE, LLC and its owners, officers, employees, and agents from claims, damages, losses, or expenses, including reasonable attorneys' fees, arising from your violation of these Terms or misuse of the Services, except to the extent caused by Retro Putt's own negligence or willful misconduct or otherwise prohibited by law.
17. Severability
If a provision of these Terms is held unenforceable or invalid, it will be limited or eliminated only to the minimum extent necessary, and the remaining provisions will remain in effect.
18. Entire Agreement
These Terms, together with our Privacy Policy, the signed liability waiver, and any transaction-specific written terms that apply, constitute the agreement between you and Retro Putt regarding the applicable Services and supersede prior agreements on the same subject.
19. Changes to These Terms
We may update these Terms from time to time. We will post revised Terms with an updated effective date. Your continued use of the Services after a change means the revised Terms will apply to your subsequent use.
